GENERAL TERMS OF ONLINE STORE green-gray.bg
I. SUBJECT
Art. 1. These general terms and conditions are intended to regulate the relations between "Join Nations" EOOD, EIK 205319722, with headquarters and address of management: Bulgaria, Varna, Knyaz Boris I Blvd. No. 85, fl. 4, referred to below for short SUPPLIER, and the customers, hereinafter referred to as USER AND/OR USER, of the green-gray.bg online store.
II. PROVIDER DATA

III. FEATURES OF THE PLATFORM
Art. 3. GREEN-GRAY.BG is an e-commerce platform, available at the Internet address http://www.green-gray.bg, through which Users have the opportunity to conclude contracts for the purchase and sale and delivery of the products offered by the Supplier on the platform goods, including the following:
To register and create a profile for viewing the Provider's electronic store and using the additional services for providing information;
To review the goods, their characteristics, prices and terms of delivery;
To enter into contracts with the Supplier for the purchase and sale and delivery of the goods offered on the GREEN-GRAY.BG platform;
To make any payments in connection with the concluded contracts, incl. through electronic means of payment.
To receive information about new goods offered by the Supplier on the GREEN-GRAY.BG platform;
To exercise their right to opt out, where applicable, under the Consumer Protection Act.
Art. 4. The supplier in the GREEN-GRAY.BG platform organizes the delivery of the goods and guarantees the rights of the Users provided for by law, within the framework of good faith, accepted in practice, consumer or commercial law criteria and conditions.
Art. 5. (1) Users conclude a contract for the purchase and sale of goods with the Supplier on the GREEN-GRAY.BG platform, at the address http://www.green-gray.bg. The contract is concluded in Bulgarian and is stored in the database of the Supplier in the platform.
(2) By virtue of the contract concluded with the Users for the purchase and sale of goods, GREEN-GRAY.BG undertakes to organize the delivery and the transfer of the ownership of the User of the goods specified by him through the interface in the platform. Users have the right to correct errors when entering information no later than sending the statement on concluding the contract to the Supplier on the GREEN-GRAY.BG platform.
(3) Users shall pay the Supplier GREEN-GRAY.BG remuneration for the delivered goods according to the conditions defined on the GREEN-GRAY.BG website and these general terms and conditions. The remuneration is equal to the price announced on the GREEN-GRAY.BG website. In the event of a technical error in the price, the Supplier immediately informs the User of the correct price of the product and has the right to refuse an order placed due to the incorrect writing of its real price.
Art. 6. (1) The User and the Supplier on the GREEN-GRAY.BG site agree that all statements between them in connection with the conclusion and execution of the sales contract can be made electronically and through electronic statements within the meaning of the Law for the electronic document and the electronic signature and art. 11 of the Electronic Commerce Act.
(2) It is assumed that the electronic statements made by the Users of the site were made by the persons indicated in the data provided by the User during registration, if the User has entered the corresponding name and password for access.
REGISTRATION FOR USE OF GREEN-GRAY.BG
Art. 7. (1) In order to use GREEN-GRAY.BG to conclude contracts for the purchase and sale of goods, the User should enter a name and password chosen by him for remote access or authenticate himself through his Facebook or Google account, with which is deemed to have accepted these terms and conditions. Acceptance of these general terms and conditions is carried out upon finalization of each order by the User.
(2) The name and password for remote access are determined by the User, by performing an online registration on the website of the Supplier GREEN-GRAY.BG, in accordance with the procedure specified therein. Users have the opportunity to place orders for the delivery of goods and a profile from the social networks Facebook, Google, Instragram.
(3) By filling in his data in the user basket and pressing the "Finish order" button, the User declares that he is familiar with these general conditions, agrees with their content and undertakes to unconditionally comply with them.
(4) The Supplier confirms the order made by the User by e-mail. An account of the User is created and contractual relations arise between him and the Provider.
(5) When registering or placing an order, the User undertakes to provide correct and up-to-date data. The user undertakes to promptly update the data specified in his registration or order in the event of a change.
GENERAL PROVISIONS
Art. 8 (1) After pressing the "Order" button, users agree to purchase the goods in the "Basket". This action is legally binding. The customer receives confirmation of the order and upon receipt of this confirmation, the contract is considered to be concluded.
(2) The supplier reserves the right to refuse delivery of a confirmed order in the event that the goods are not available. In case of lack of stock of the requested product, the trader shall notify the customer of the stock-out as soon as possible by sending a message to the email address specified by the customer or to the telephone number specified. In the event that a transfer is made to the merchant's account, the customer will be able to choose between a refund, cancellation of the order or a replacement order.
(3) The contract language is Bulgarian, and payments will be made in Bulgarian levs
DELIVERY
Art. 9 (1) Immediately after delivery, the goods should be inspected carefully by the User. Any damages, shocks or other damages should be reported immediately to the dealer. If an incorrect or incorrect address, contact person and/or phone number are specified when submitting the request, the merchant is not bound by any obligation to fulfill the order.
(2) When the delivered goods clearly do not correspond to the goods requested for purchase by the customer and this can be established through a simple inspection, the User may request that the delivered goods be replaced with goods corresponding to the purchase application made by him within a period of 24 hours from its receipt, in which case the transport costs are borne by the merchant.
(3) In the event of a refusal to receive the goods, apart from the cases described above, the refusal is considered unfounded. Transport costs in this case are FOR THE ACCOUNT OF THE USER according to the rates of the courier company. (In case of exchange of goods, the user pays 2 courier fees for transport in both directions). The packaging must not be torn or damaged, it must be in the form in which it was received. The goods must not have been processed and used, but must be in the original packaging and together with all its accessories.
(4) In the event that the User is not found within the deadline for delivery to the specified address or access and conditions for delivery of the goods are not provided within this deadline, the trader is released from his obligation to deliver the goods requested for purchase.
(5) The User has the right, without owing compensation or a penalty and without stating a reason, to withdraw from the concluded contract within 15 days, starting from the date of acceptance of the goods by the Supplier. When the User has exercised his right of withdrawal from the contract at a distance or from the contract off-premises, the Supplier shall refund all sums received from the user without undue delay and no later than 14 days from the date on which he was notified of the consumer's decision to withdraw from the contract and in the event that he has already received back the goods subject to the contract. The supplier reimburses the amounts received by bank transfer
VII. USER RIGHTS AND OBLIGATIONS
Art. 10 (1) The user bears full responsibility for the protection of his username and password, as well as for all actions that are carried out by him or a third party using the username and password. The user is obliged to immediately notify the merchant of any case of unauthorized access using his username and password, and whenever there is a risk of such use.
(2) The user is obliged to pay the price of his order according to the announced price on the GREEN-GRAY.BG page.
(3) The user undertakes to indicate an accurate and valid telephone number, delivery address and e-mail address, to pay the price of the goods, to pay the costs of delivery when the same is not free and to ensure access and the possibility of receiving the goods. In the event that it is not explicitly stated that the delivery is free, it is considered paid.
Art. 11 Each user, regardless of whether he is a client of the trader, undertakes when using the services:
(1) not to violate and respect the fundamental rights and freedoms of citizens and human rights, according to the Constitution and laws of the Republic of Bulgaria and recognized international acts;
(2) to comply with Bulgarian legislation, applicable foreign laws, rules of morality and good manners and Internet ethics when using the services provided by artservicebg.com;
(3) to immediately notify the merchant of any case of committed or detected violation when using the provided services;
(4) to indemnify the merchant and all third parties for all damages suffered and lost profits, including for any costs and attorneys' fees paid, incurred as a result of claims made by and/or damages paid to third parties in connection with Internet pages, hyperlinks , materials or information that the User has used, placed on the server, sent, distributed, disclosed to third parties or made available through green-gray.bg in violation of the law, these General Terms and Conditions, Good manners or Internet ethics;
VIII. PROVIDER'S RIGHTS AND OBLIGATIONS
Art. 12 (1) The provider does not have the obligation and the objective opportunity to control the way users use the services provided.
(2) The provider has the right at any time, without notifying the client, when the latter uses the services in violation of these terms and conditions, as well as at the provider's discretion to terminate, stop or change the services provided in connection with the use of the site.
(3) The provider is not liable towards users and third parties for damages suffered and lost benefits that occurred as a result of the termination, suspension, change or limitation of services, deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials or information, transferred, used, recorded or made available through green-gray.bg.
(4) After receiving the payment, the supplier undertakes to transfer to the consumer the ownership of the goods requested for purchase by him, to deliver the goods requested for purchase on time.
(5) The provider is not responsible for damages caused to the software, hardware or telecommunications equipment, or for loss of data resulting from materials or resources searched, loaded or used in any way through the services provided. The advice, consultation or assistance provided by the specialists and employees of the provider in connection with the use of the services by the users does not give rise to any responsibility or obligations for the provider.
(6) The provider has the right to collect and use information relating to its customers, regardless of whether they are registered. During account registration, the customer undertakes to familiarize himself with this document. After ticking, it is considered that the user has familiarized himself with and agrees with the declaration. In the event that the user states that he does not agree, the provider has the right to immediately suspend or terminate the provision of services to the user.
(7) The information under the previous article can be used by the supplier, except in case of express disagreement of the user, sent to an e-mail address or from the contact form. The supplier collects and uses the information only to perform the service of selling the goods to the customer and to improve the services offered. All purposes for which the provider will use the information will be in accordance with Bulgarian legislation, applicable international acts and good morals.
(8) The supplier is not responsible for failure to fulfill its obligations under this contract in the event of circumstances that the merchant did not foresee and was not obliged to foresee - including, cases of random events, problems in the global Internet network and in the provision of services beyond the merchant's control.
TERMINATION
Art. 13. These general terms and conditions and the User's contract with the Supplier on the GREEN-GRAY.bg platform are terminated in the following cases:
upon termination and declaration of liquidation or declaration of bankruptcy of one of the parties to the contract;
by mutual agreement of the parties in writing;
in case of objective inability of one of the parties to the contract to fulfill its obligations;
when the equipment is seized or sealed by state authorities;
in case of deletion of the User's registration on the GREEN-GRAY.bg platform. In this case, the concluded but unexecuted purchase and sale contracts remain valid and enforceable;
Art. 28. The Supplier has the right at its discretion, without giving notice and without paying compensation, to unilaterally terminate the contract, in case it finds that the User uses the GREEN-GRAY.BG platform in violation of these general terms and conditions, the legislation of the Republic of Bulgaria, the generally accepted moral norms or generally accepted rules and practice in electronic commerce.
